Declaration and Undertaking
I, the undersigned applicant (“Applicant”), in connection with my application for a loan facility (“Facility”) from ATM Capital Private Limited (“Lender”), do hereby solemnly declare, confirm, and undertake as under:
1. Acknowledgement of Terms
I confirm that I have carefully read, understood, and agreed to all terms, conditions, and other requirements specified in the loan application form and on the Lender’s official website www.atmcapital.com, including but not limited to: (a) the Interest Rate Policy, (b) the Schedule of Charges, and (c) the List of Documents to be submitted.
2. Discretion of the Lender
I acknowledge that sanction and disbursement of the Facility are subject to execution of requisite documents, completion of closing formalities, and approval of the Lender, who shall have absolute discretion to accept or reject my application without assigning any reason. I further agree that all documents, information, photographs, and records submitted by me shall remain with the Lender and will not be returned
3. Accuracy of Information
I hereby represent and warrant that all details, documents, and declarations provided by me, whether in this application or otherwise, are true, correct, complete, and up-to-date. I confirm that I have not concealed or suppressed any material information.
4. Solvency Status
I affirm that no insolvency, bankruptcy, or similar proceedings have ever been initiated against me, nor have I been adjudicated insolvent, declared bankrupt, identified as a wilful defaulter, or classified as a non-cooperative borrower by any bank, financial institution, or authority.
5. Consent for Data Sharing
I expressly authorize the Lender, its group entities, affiliates, and service providers to verify, process, and share any information and documents submitted by me, including but not limited to my loan history, repayment records, and other financial data, with third parties such as banks, financial institutions, credit bureaus, statutory authorities, or telecom companies, for the purposes of credit appraisal, rating, analytics, monitoring, compliance, and related activities.
6. Promotional Communications
I provide my consent to the Lender and its group entities to contact me through calls, SMS, emails, or other communication channels for promotional offers and information regarding their products or services. I confirm that my rights under the National Customer Preference Register (NCPR)/National Do Not Call Registry (NDNC) shall not restrict such communication.
7. Aadhaar Based Authentication
I voluntarily consent to provide my Aadhaar number and related authentication data (including Biometric/One-Time Password) for identity verification through the Aadhaar authentication system, solely for the purpose of processing and availing the Facility. I understand that the Lender shall ensure strict security, confidentiality, and limited usage of my Aadhaar details as required under applicable law.
8. Electronic Record
I acknowledge that this declaration constitutes an electronic record executed in accordance with the provisions of the Information Technology Act, 2000, and applicable rules thereunder. This record is generated electronically and does not require any physical or digital signatures.
9. Binding Undertaking
I confirm that the above statements are true to the best of my knowledge and belief. I agree that this declaration shall form an integral part of my loan application and shall be binding upon me.
